By registering for, accessing, or using Colour Green, you acknowledge and agree to be bound by these Terms. Usage of Colour Green or its services is conditional upon acceptance of all these Terms. If you are not in agreement with any part of these Terms, please refrain from using Colour Green.

Account means the user profile you create and manage on Colour Green for accessing our services.
Customer refers to any individual or entity who registers on Colour Green with the purpose of seeking services.
Service Provider refers to a New Zealand registered business entity that is registered on the Colour Green platform to offer and provide services to Customers. This designation is exclusively for businesses that are legally recognised and registered in New Zealand.
Colour Green Content includes all content provided on the Colour Green website, such as text, graphics, and images, excluding User Content.
User Content is content uploaded, posted, or published on Colour Green by Users, which includes job postings, service offerings, and feedback.
Services encompass all functionalities, features, and services provided by Colour Green that facilitate interaction and transactions between Customers and Service Providers.
Privacy Policy refers to Colour Green's policy outlining the handling of personal information of its users.
Feedback includes any comments, suggestions, or other input provided by users about the Colour Green platform or services.
Paid Services are services on Colour Green that involve financial transactions between \ Service Providers and Colour Green.
Colour Green Website refers to the website located at https://colourgreen.co.nz, which is the platform for providing the Services.
Success Fee refers to the fee charged to Service Providers by Colour Green for the purchase of contact details of a Customer who has posted a job.
Unacceptable Use covers behaviours prohibited on Colour Green, including harassment, rights violation, and other forms of misuse.
Dispute Resolution: Colour Green do not provide any mechanism for dispute resolution between customers and service providers. Instead, Colour Green can provide the profile information of the involved parties in the dispute..
Effective Date is the date from which these Terms are applicable.
SSL Certificate is a digital certification that authenticates a website's identity and enables secure connections .
Cookies Notification is an alert informing users about the use of cookies on the website for data collection purposes .
Electronic Contracts are agreements formed through electronic communications as recognised by New Zealand law .
In these Terms, unless the context requires otherwise:
(a) References to statutes include all regulations under, amendments to, and any legislation that replaces such statutes.
(b) The singular includes the plural and vice versa.
(c) Monetary amounts are in New Zealand dollars (NZD).
(d) “Party” or “parties” refer to those bound by these Terms.
(e) “Person” includes both natural persons and legal entities.
(f) Terms like “includes” or “including” are to be interpreted without limitation.
Service Providers:
Account Registration: Service Providers must register and create an account to offer services on Colour Green. The registration process requires detailed professional information, including business details, service offerings, and compliance with New Zealand Companies Office registration if applicable.
Profile Completeness: Service Providers are encouraged to maintain a comprehensive and up-to-date profile, including relevant licenses, certifications, and experience to enhance their credibility with potential customers .
Security and Confidentiality: Like Customers, Service Providers are responsible for the security of their account information and must take steps to prevent unauthorised access.
Professional Conduct: Service Providers are expected to uphold high standards of professionalism in their interactions on the platform, both in their service offerings and communications with Customers.
Compliance with Platform Policies: Service Providers must adhere to Colour Green's policies, including the payment of any success fees.
We reserve the right to refuse to open an Account and do not need to provide reasons for doing so.
Bidding Limitation: It is important for Service Providers to understand that for each job posted by a Customer on the Colour Green platform, only up to three Service Providers will be permitted to submit a bid. This limitation is to ensure that each proposal is given thorough consideration by the Customer and to foster a competitive environment that emphasizes the quality and suitability of services offered. Additionally, Service Providers should be aware that all transactions related to the jobs they bid on, including interactions with Customers, will be documented and visible in their profile for a period of one year.
Job Listing Viewing and Management:
Job Listings Access: Service Providers have access to the 'Jobs' page on their account, featuring 'All Jobs' and 'Applied/Hired Jobs' sections.
All Jobs Section: This section displays job listings that match the Service Provider's selected services, showing only basic job descriptions. Full job details, including customer contact information, are not accessible in this state.
Full Access through Purchase: To access complete job details including customers contact details, Service Providers must pay a specified fee. Upon payment, the job listing moves to the 'Applied/Hired Jobs' section.
Applied/Hired Jobs Section: This section provides full access to job listings, including all customer details, for a period of one year from the date of purchase.
Notification of New Listings: Service Providers will receive email notifications about new job listings relevant to their service categories.
Listing Visibility Duration: Job listings in the 'Unpurchased' section remain visible for three months, ensuring up-to-date and relevant opportunities.
General Provisions for Service Providers:
Responsibility for Activities: Service Providers are responsible for their interactions on our platform. Colour Green is an interactive website where users contribute content that may be published. Service Providers must ensure they have the right to use any third-party content they contribute. This responsibility includes maintaining the confidentiality of account information and passwords and ensuring that all activities under their account comply with the terms of service. Any unauthorized use of an account or any other breach of security must be immediately reported to Colour Green.
Notification of Unauthorized Use: Service Providers are required to immediately notify Colour Green in the event of any suspected unauthorized use of their account or any other security breach. Prompt notification helps ensure swift action to protect the user’s account and the integrity of the platform. Colour Green will take necessary steps to address the issue, but Service Providers are responsible for any unauthorized use of their account until Colour Green is informed of the security breach.
Account Termination: Colour Green reserves the right to suspend or terminate a Service Provider's account at its sole discretion for any breach of these Terms, or for any activities deemed detrimental to the platform or its user community. This includes, but is not limited to, fraudulent activities, misuse of the service, or any other actions that negatively impact the platform or its users.
Inactive Account: An account will be classified as inactive if it has not been accessed for a period exceeding one year. In an effort to keep you informed, we will initiate contact after a period of 3 months of inactivity, followed by a subsequent notice after 6 months. If your account remains inactive after these notices, we will proceed with the permanent deletion of your account.

This ensures a cohesive understanding and adherence to our commitment to protect your privacy in compliance with New Zealand’s privacy laws.
Dual Role Usage Clause
Service Provider as Customer: Service Providers registered on the Colour Green platform are permitted to also utilise the platform in the capacity of a Customer. This means that Service Providers can seek, and avail services offered by other registered Service Providers on the platform, subject to the same terms and conditions applicable to Customers.
Customer as Service Provider Restrictions: Customers wishing to register as a Service Provider on the Colour Green platform must meet specific eligibility criteria, including but not limited to possessing a valid New Zealand Business Number (NZBN). This requirement ensures that only legally recognized business entities in New Zealand can offer services on the platform. Customers without an NZBN are not eligible to register as Service Providers and are limited to utilizing the platform solely in the capacity of a Customer.
Compliance with Terms: All users, regardless of whether they are utilizing the platform as a Service Provider or Customer, are required to comply with all applicable terms and conditions set forth by Colour Green. This includes adherence to policies related to user conduct, payment obligations, and privacy regulations.
Content Creation, Use, and Intellectual Property for Service Providers:
User Content Creation and Posting:
Service Providers: When posting job proposals or creating profiles, Service Providers can create content, including descriptions of services, qualifications, and upload relevant images or documents showcasing their work. This content should be accurate, honest, and not misleading.
Content Ownership and Responsibility: All User Content created and posted on Colour Green by Service Providers is owned by the respective Service Providers. Service Providers are solely responsible for the content they post, ensuring it complies with all applicable laws and Colour Green policies.
Use of Content on the Platform: User Content created by Service Providers is used on the Colour Green platform to showcase their services to potential Customers. Service Providers grant Colour Green a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such content within the platform for the purpose of service provision.
Intellectual Property of Colour Green:
All content and material on the Colour Green website, including but not limited to the website design, text, graphics, and interfaces, are the exclusive property of Colour Green Limited and are protected under intellectual property laws.
The Colour Green name, logo, and any related service names are trademarks of Colour Green Limited and may not be used without prior written permission.
Respect for Third-Party Intellectual Property:
Service Providers must ensure that any content they post do not infringe upon the intellectual property rights of third parties. This includes ensuring that all uploaded materials, images, or text are either owned by the Service Provider or properly licensed.
Feedback and Suggestions:
Service Providers are welcome to provide feedback or suggestions about Colour Green's services. Any feedback given is considered non-confidential and non-proprietary. Colour Green is free to use this feedback without obligation to the Service Provider.
Prohibited Content:
Service Providers must not upload, post, or transmit any content that is illegal, offensive, defamatory, infringing on others' rights, or otherwise objectionable. Colour Green reserves the right to remove such content and take appropriate action, including account suspension or termination. In addition to the above, Colour Green actively moderates user-generated content. We reserve the right to remove content that repeatedly infringes copyright, and to take appropriate measures against Service Providers who engage in abusive or illegal activities. We will cooperate with authorities as necessary in cases involving content that breaches others' rights or is unlawful.
Privacy and Data Protection for Service Providers:
If you provide us with personal information, then our Privacy Policy applies. Please read the Privacy Policy carefully as it forms a part of these Terms. By using the Services as a Service Provider, you are permitting us to, and you warrant that you have obtained all necessary consents and authorizations as required to allow us to collect, hold, use, store, and share any personal information you upload or post on Colour Green, or otherwise provide to us, in accordance with our Privacy Policy.
Colour Green is committed to protecting the privacy and security of our Service Providers' personal information. Our practices are in full compliance with the Privacy Act 2020 and other relevant data protection laws in New Zealand.
Collection of Personal Information:
We collect personal information that you provide directly when you register an account, create a profile, or communicate through our platform. This may include your name, contact details, business information, and any other information you choose to provide.

We implement appropriate technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction.
Service Providers should be aware that no internet-based platform can guarantee absolute security.
Service Provider Rights and Access:
Service Providers have the right to access, update, or request deletion of their personal information held by Colour Green.

Service Providers agree to the fee structure set forth by Colour Green for using the platform. This may include any Success Fees payable by Service Providers upon successful purchase of contact information from Customers who have posted jobs.
Payment Methods:
Payments are to be made through accepted methods, primarily via credit card. Service Providers must ensure timely and full payment of any fees owed.
Refunds and Cancellations:
Given the nature of services offered, refunds may not be available once a Service Provider purchases contact information for a job posted by a Customer. Detailed policies on cancellations and refunds will be available on the platform.
User Conduct and Responsibilities:
Acceptable Use:
Service Providers must conduct themselves in a manner that is respectful, lawful, and in accordance with the platform's guidelines. Prohibited activities include harassment, infringement of intellectual property, and fraudulent practices.
Accuracy of Information:
Service Providers are required to provide accurate and truthful information on the platform, both in their profiles and in any communication.
Limitation of Liability and Disclaimer of Warranties:
Limitation of Liability: Colour Green’s liability in connection with the use of the platform is limited to the extent permitted by law. The platform is provided "as is" without warranties of any kind.
Disclaimer: Colour Green does not guarantee uninterrupted service or error-free operations and disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Indemnification:
Service Providers agree to indemnify and hold harmless Colour Green, its affiliates, officers, agents, and employees from any claim or demand made by any third party due to or arising out of the Service Provider's use of the platform, breach of these Terms, or violation of any law or rights of a third party.
Termination and Suspension of Accounts:
Colour Green reserves the right to suspend or terminate a Service Provider's account for breach of these Terms, illegal or unethical use of the platform, or for any other reason deemed necessary for the integrity and security of the platform.
Modifications to the Terms and Conditions:
Colour Green may modify these Terms at any time. Service Providers will be notified of any significant changes via email or through a notification on the platform. Continued use of the platform after such changes constitutes acceptance of the new Terms.
Email Notifications and Commercial Messages:
Colour Green may send email notifications that could include commercial messages. By subscribing to our email notifications, Service Providers consent to receive such messages. We will clearly indicate the commercial nature of any content at the time of subscribing.
Customer Reviews on Service Provider Profiles:
Review Submission:
Customers who have availed services from a Service Provider via the Colour Green platform are encouraged to submit reviews on the Service Provider’s profile. These reviews should reflect their experience, including the quality of service, professionalism, and overall satisfaction.
Review Content:
Reviews must be honest, respectful, and constructive. Customers are expected to provide factual and specific feedback that is helpful to both the Service Provider and other potential customers. Reviews should not contain any offensive language, personal insults, or irrelevant content.
Non-Endorsement: Reviews are user-generated content and do not reflect the views or endorsements of Colour Green. We do not verify the accuracy or truthfulness of reviews but provide a platform for customers to share their experiences.
"Get Hired" Feature for Service Providers
Access to Applicant CVs: In the 'Get Hired' section of our platform, service providers will have access to CVs posted by applicants seeking employment. These CVs will be displayed within the service provider's profile under a designated section. However, full access to detailed CV information, including email, phone numbers, and the complete CV, will only be available to service providers upon payment.
Compliance with Privacy and Data Protection Laws: Service providers must adhere to strict privacy and data protection standards when handling applicant CVs. This includes not sharing, distributing, or using the information for any purposes other than potential employment opportunities related to their services.
Proper Use of Applicant Information: The information obtained from applicants’ CVs must be used solely for the purpose of evaluating the applicant for employment within the service provider’s business operations. Any misuse of this information is strictly prohibited.
Responsibility for Compliance: Service providers are responsible for ensuring that their use of the 'Get Hired' section and applicant CVs complies with all applicable laws, including employment and privacy laws.
Modification or Removal of the Feature: We reserve the right to modify or remove the 'Get Hired' section from our platform at any time. Service providers will be notified of any such changes and must comply with the revised terms.
General Provisions:
These Terms constitute the entire agreement between Service Providers and Colour Green regarding the use of the platform. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
